Personal Data Processing Consent
This document requests your consent for personal data processing where consent is legally required. Consent is not the sole legal basis for all processing on FitSpace. Account creation, delivery of purchased content, payment processing, and support necessary to perform your contract are handled under other lawful bases (including contract performance), as described in our Privacy Policy.
1. Data Controllers / Operators
Personal data is processed by:
- Individual Entrepreneur Vladislav Vasilevich Novoloake (ИП Новолоакэ Владислав Васильевич), TIN 502507145530, OGRNIP 325508100380873, Russian Federation — primary operator for RUB / YooKassa users.
- FLOWPIX LIMITED, company number 16157203, 128 City Road, London EC1V 2NX, United Kingdom — for international / Stripe routes.

2. What this consent covers
By registering or using the FitSpace platform (the “Platform”), you consent to processing only for the following purposes that require consent:
- Marketing and promotional communications (if you opt in);
- Analytics cookies and similar technologies — where consent is required;
- Health-related data — when you enable the Health diary, sync health data from your device, or use Trainer Space coaching features where you voluntarily provide health-related information (workouts, steps, sleep, nutrition, check-ins, uploaded files).
Performance of your core paid license and purchased content access does not depend on this consent, except for features that legally require consent (marketing, optional health and coaching features).
3. Categories of Personal Data (within this consent)
- Name and email address;
- Phone number (if provided for marketing or support);
- IP address, device type, browser, and operating system (for consent-based analytics);
- Usage data (for consent-based analytics);
- Health-related data when you enable those features;
- For AI voice translation: audio files of your course are temporarily sent to our partner, ElevenLabs, for speech synthesis. No name, email, or other personal identifiers are shared with ElevenLabs.
4. Localization and conditions of processing
- Processing is performed both with and without automated means.
- Localization (Russian users): personal data of Russian Federation citizens is primarily recorded, stored, and processed on the territory of the Russian Federation before cross-border transfer, as required by FZ-152.
- Data may be shared only with payment processors, infrastructure processors under DPA, and authorities when required by law.
- International transfers after localization use Standard Contractual Clauses or equivalent safeguards where applicable. We do not claim universal certification.
5. Retention
Data processed on the basis of consent is kept until you withdraw consent or the purpose is fulfilled. Financial and tax records may be retained up to 5 years where required by applicable tax or commercial law, regardless of marketing or optional-feature consent withdrawal.
6. Security
We use encryption, access controls, and monitoring. No system is 100% secure; we do not guarantee absolute protection against all threats.
7. Your Rights
You have the right to access, correct, delete, restrict, port, and object to processing, and to lodge a complaint with a supervisory authority. Contact: support@fitspace.app, privacy@fitspace.app.
8. Withdrawal of Consent
You may withdraw consent at any time by email to support@fitspace.app or privacy@fitspace.app.
Withdrawal does not affect the lawfulness of processing before withdrawal or contract performance already carried out on other lawful bases. Marketing and optional health/coaching features may become unavailable.
9. Trainer Space and health-related data
Trainer Space processes coaching goals, check-ins, coach notes, chat, schedules, uploaded files, and health-related information when you enable those features. Data is shared with the Author identified at checkout to perform the coaching contract.
The Author is controller for coaching purposes; FitSpace is processor under the DPA. FitSpace is a separate controller for accounts, payments, security, mandatory records, and support.
Health-related data is processed when you enable those features, under applicable law (including GDPR Art. 9 and CCPA where applicable). You may omit optional information; some features will then be unavailable.
